Terms of Service

These Terms of Service ("Terms") govern your use of Sprachbau — the website, mobile app, and supporting services (collectively, the "Services") — operated by Shibby Ventures LLC ("we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER (SECTION 9) THAT AFFECT YOUR LEGAL RIGHTS.

1. Acceptance and eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract, to use the Services. By using them, you represent that you meet these requirements and will comply with these Terms and all applicable laws.

2. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own lawful learning. We reserve all rights not expressly granted. You may not copy, modify, reverse engineer (except where that restriction is prohibited by law), distribute, sell, or create derivative works from the Services except as expressly permitted.

3. Your content

You retain ownership of the text you submit (such as writing you send for grading). You grant us a limited license to process that text solely to provide the Services — including sending it to our AI provider to generate feedback. You are responsible for the content you submit and for ensuring you have the right to submit it.

4. AI-generated feedback is not authoritative instruction

Generated sentences and grading are produced by automated systems and may contain errors. The Services are a study aid, not a substitute for a qualified instructor, and we make no guarantee of linguistic accuracy or learning outcomes.

5. Acceptable use

You agree not to misuse the Services, including by:

• attempting to access accounts or data that are not yours;
• disrupting, overloading, or probing the Services or their infrastructure;
• using the Services for any unlawful purpose or to submit unlawful content.

6. Availability and changes

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms; material changes are reflected by the effective date above, and continued use constitutes acceptance.

7. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIBBY VENTURES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES.

9. Arbitration and class action waiver

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, and not in a class, collective, or representative action. You and we waive any right to a jury trial. You may opt out of this provision by notifying us in writing within 30 days of first accepting these Terms.

10. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules.
